1. Scope and Agreement
1.1. These General Terms and Conditions (T&Cs) govern the contractual relationship between Blue Sky Taxi AG (referred to as “Blue Sky Taxi,” “We,” or “The Company”) and the customer (referred to as “Customer” or “You”) for the provision of taxi, transfer, and related transportation services. 1.2. By booking any service, the Customer explicitly accepts these T&Cs. 1.3. The registered office of the Company is at Zielstrasse 5, 8400 Winterthur, Switzerland. The governing law is Swiss Law, with the competent place of jurisdiction being Winterthur.
2. Booking and Confirmation
2.1. Bookings can be made online, via phone, or through approved partners. 2.2. A contract is established only upon written confirmation (email or SMS) from Blue Sky Taxi, which will include the agreed-upon price, date, time, and service details. 2.3. The Customer is responsible for ensuring all provided details (e.g., pickup address, date, flight number) are accurate and complete. Blue Sky Taxi is not liable for errors resulting from incorrect information supplied by the Customer.
3. Fares and Payment
3.1. Fares: Fares are calculated either by the official taximeter rate applicable in Winterthur/Canton of Zürich (for street pickups/on-demand) or as a fixed, pre-agreed price for pre-booked transfers (e.g., airport transfers). 3.2. Fixed Price Guarantee: Fixed prices are guaranteed and will not change, even if the journey time is longer due to traffic or diversions, provided the route and destination remain as originally booked. 3.3. Waiting Time: * Airport Pickups: We include [e.g., 60 minutes] of free waiting time from the actual flight landing time. Subsequent waiting time will be charged at [e.g., CHF 1.30] per minute (or CHF 78.00 per hour). * Other Pickups: We include [e.g., 10 minutes] of free waiting time from the scheduled pickup time. Subsequent waiting time will be charged at the standard waiting rate. * The driver will attempt to contact the Customer before marking the booking as a “No-Show.” 3.4. Payment: We accept cash (CHF), major credit/debit cards (Visa, Mastercard, Amex), and TWINT. For credit card payments, a surcharge of [e.g., 3%] may apply, which will be disclosed during the booking process. Corporate account holders are subject to agreed invoice terms.
4. Cancellation and Refunds
4.1. The cancellation policy is fully detailed in the Refund Policy below, which forms an integral part of these T&Cs. 4.2. Cancellations must be submitted in writing (email to info@blueskytaxi.ch) or by calling the central dispatch number.
5. Customer Obligations and Conduct
5.1. Customers must wear seat belts at all times. Smoking, vaping, and the consumption of alcoholic beverages are strictly prohibited inside the vehicle. 5.2. The Customer is responsible for their luggage and ensuring that any undeclared excess or oversized luggage can be safely transported. Additional charges may apply for undeclared items requiring a larger vehicle. 5.3. The driver reserves the right to terminate the journey immediately without refund if the Customer’s behavior compromises the safety of the driver, the vehicle, or other passengers, or violates Swiss law.
6. Limitation of Liability
6.1. Blue Sky Taxi is liable for damages caused by the Company’s gross negligence or willful misconduct. 6.2. The Company is not liable for delays or missed connections caused by circumstances beyond its reasonable control (Force Majeure), including, but not limited to, accidents, severe weather, unexpected traffic congestion, road closures, or governmental actions. 6.3. Liability for lost or damaged luggage is limited to [e.g., CHF 500] per booking, provided the loss or damage is due to the fault of Blue Sky Taxi.
